Legal Myth-Busting: Separating Myths, Fiction From Truths!
There are many misconceptions about the law that can lead to confusion and even legal trouble. Let’s bust some of the most common legal myths!
1️⃣ Myth: If the police don’t have a warrant, they can’t arrest you.
✅ Truth: In Nigeria, the police can arrest you without a warrant in certain situations, such as if they catch you committing a crime or have reasonable suspicion. However, they must inform you of the reason for the arrest and your rights.
2️⃣ Myth: If a contract isn’t written down, it’s not legally binding.
✅ Truth: A contract can be valid even if it’s made verbally, as long as it meets the basic legal requirements (offer, acceptance, consideration, and intention to create legal relations). However, written contracts are always safer for proof.
3️⃣ Myth: If someone owes you money, you can seize their property.
✅ Truth: No, you cannot just take someone’s property because they owe you. You must go through legal channels, such as obtaining a court judgment and enforcement order. Self-help actions can get you into trouble.
4️⃣ Myth: You must always speak to the police when questioned.
✅ Truth: You have the right to remain silent and not incriminate yourself. You can ask to speak with a lawyer before answering any questions.

✅ Truth: Adultery is a ground for divorce, but it does not mean an automatic divorce. You must go to court and prove it, along with showing that the marriage has broken down irretrievably.
6️⃣ Myth: Once a tenant stops paying rent, the landlord can evict them immediately.
✅ Truth: Landlords must follow due process by issuing the appropriate quit notices and obtaining a court order. Forceful eviction is illegal and can result in penalties.
7️⃣ Myth: If you find something valuable, it automatically belongs to you.
✅ Truth: Keeping lost property without trying to return it can be considered theft, especially if the rightful owner can be identified.
