Ibom Air vs. Comfort Emmanson: Safety Is Not a Licence to Strip Away Rights

When Enforcement Becomes Abuse

What began as an in-flight dispute ended with Comfort Emmanson in prison, facing multiple charges, and banned for life from flying with any Airline Operators of Nigeria (AON) member airline.
But behind the “unruly passenger” label lies something deeply troubling, a public stripping of dignity, privacy, and fair process. Let's xray rights violated in the process.

1. Dignity Violated

Section 34 of the Nigerian Constitution is unambiguous: every person is entitled to dignity of the human person.
Forcibly removing Emmanson’s clothing in public, while cameras rolled, is degrading treatment the kind of conduct human rights laws exist to prevent.

2. Privacy Shattered

Section 37 guarantees privacy of person.
Recording her in a state of undress and sharing that footage online without consent isn’t just unethical, it’s potentially criminal under the Cybercrimes Act.

3. Fair Hearing Denied

The lifetime ban was imposed with no formal hearing, no right of reply. Section 36 of the Constitution demands due process before punishment, a principle that applies to courtrooms and to corporate sanctions.

4. Equal Standards for All

In other seemingly high profile cases, sanctions have been more measured.
If justice is to mean anything, the rules must be the same for everyone, celebrity or not.

What Needs to Happen

Suspend the lifetime ban pending independent review.

Investigate and prosecute those responsible for recording and circulating the indecent footage.

Publish clear passenger discipline protocols with fair hearing safeguards.

Train airline and security staff in de-escalation and rights-respecting enforcement.

In as much as we agree that airline safety is vital but so is human dignity.
No passenger, guilty or innocent, should be humiliated in the name of security.
In the air or on the ground, rights are not optional.

💬 Street Lawyer Verdict: Justice is not just about punishment, it’s about fairness. And in Comfort Emmanson’s case, fairness was left at the boarding gate.

There's a need for a critical independent review and accountability
